- Confirm that the job offered to you in Form I-140, Petition for Alien Worker, remains a bona fide job offer that you intend to accept once your Form I 485, Application to Register Permanent Residence or Adjust Status, is approved. Beginning Jan. 17, 2017, if you are filing or have previously filed Form I-485 based on being the principal beneficiary of a valid Form I-140 in an employment-based immigrant visa category that requires a job offer, you will need to file Supplement J instead of submitting a job offer letter;
- 8 老师的回答是 Because you still work for the I-140 sponsor, you don't need to provide this form. 但是网上有人没换工作的情况下被RFE J 表，所以USCIS 的意思是不是从2017年开始就必须填写了？因为目前我的职位和工资并不是拿到485后的那个 offer, 所以还是需要 J 表说明这个 OFFER 是存在的？-You are right. USCIS has changed the rule for I-485 J (I didn't realize it), so you need to file this form with your I-485. I just answer your previous questions about this form here:
- 此表格中，employer confirming an existing bona fide job offer 必须填写part 5,6,7 也就是我的老板需要填写这个部分。 问题： 在part 6 information about job offer 中 Q2: SOC code 是否就是当时file 140 上面填写的一致？-Yes Q 7 , wage offered, 是指现目前拿到的工资(低于当时办perm 划分的Prevailing wage )，-No. 还是指拿到绿卡后需要达到的Prevailing wage，也就是当时file 140上面写的 proposed employment wages ? -Correct.
- 补加一个问题，最近爱人的公司给他办的EB3 perm approval, 准备递交 140， 同时我们这边他要递交以我的 EB2 为准的副卡，以前问过8老师，两个case 不冲突，不用通知他们公司的律师或者 USCIS。如果以后爱人拿到副卡，是否公司帮他准备的 EB3 case 就自动取消了吗？或者说只要不提交以他的 EB3 为背景的485, 他的 case 就自动close 了？-Your spouse just does not need to file I-485; or just inform his employer to withdraw the EB3 I-140 after he gets the green card with you.
