先生在前一个公司，曾经拿过I-140，Priority date是2014年8月中，现在EB3已经current了，想请教几个问题：

1）新公司申请的劳工卡已经approve了，因为以前有I-140，能不能同时file I-485？
-Yes. Talk to the lawyer.

a) 孩子现在还不满21岁，如果现在一起file I-485, 是不是以后即使拿到绿卡时，超过21岁也没有问题了，对吗？-Right.

b) file I-485后，我和孩子就都可以申请EAD对吗？-Yes. You and your child can apply for EAD and AP at the same time together with I-485 filing.

2）如果不行，可以申请I-140premium processing吗？-Yes.

会不会更容易被REF，
-No because your I-140 is not EB1.

所以还是保守点，申请regular processing比较好？
