8 老师您好，

请教您一个问题。我太太EB2 140 很早就approaved，但去年5月downgrad to EB3，同时递交了EB3 140 和 485，目前EB3 的140 还处于pending状态，目前priority date 又当前了，请问在这种情况下，USCIS 处理她的485 case 吗？
 
还是必须等EB3 的 140 approved 了才处理？
-Yes. Only I-140 is approved first, then I-485 may be approved later. Why doesn't she ask the employer to use premium processing to get the I-140 result in 15 days now? Talk to the lawyer.
