我妹妹的I140刚刚批准，现在是H1B身份
我妹夫现在用OPT工作，抽了两年的H1B也没抽中，明年还有最后一次机会，OPT明年11月过期
现在想让我妹夫申请H4 EAD,
但是公司的律师说H4先批准，EAD后批准，中间的gap不能工作，长时间没批的话就要辞退。
我想请问您
1）您建议我妹夫如何保持合法的工作许可，EAD还是等H1抽签？
-He can compete the H-1 first, and if he can get the H-1 quota, then change F-1 to H-1. If no, he can change F-1 to H-4 and apply for the H-4 EAD at the same time (i.e. file I-539 and I-765 at the same time), and thus USCIS will approve his H-4 and then, approve the EAD immediately or very short time after the H-4 approval. He also can change F-1 to H-4 and apply for the H-4 EAD, then also can complete the H-1 quota later.
2）H4 EAD真的很快要被取消了么？会在明年初出行政令么？
-I really don't know what will happen.
3）拿H4 EAD不影响申请H1B抽签吧？
-Not affect anything.
4）H4 批准了以后，OPT EAD是立即就失效 么？
-Right.
5）H4批准和EAD批准中间大概要多长时间的gap? 有办法加急么？
