我背景：离异，儿子美国公民在上大学，今年6月满21岁如果为我申请绿卡，面临以下几个问题

1，资金担保，儿子没收入，如果我赠送给他10万是否可以作为担保？

-No.

2，可以让我妹妹妹夫提供担保（他们是大学教授收入应该没问题），他们是和我儿子作共同担保人？还是独立担保我？

-Your son is sponsor, and your sister/brother-in-law is joint sponsor.

3，我现在10年b签证，如果我在美国内申请，有人说要入境3个月后再申请，有这个说法吗？

-No lawyer requires that, but practically yes in case USCIS consider that you have the immigrant intent before you enter US (B-2 visa fraud).

4，如果在美国申请，同时递交申请和回美证申请，回美证多久能批下来？

-About 3 months. You may go to the local USCIS Office to apply for emergency advance parole if you have the reason to prove that it is urgent for you to leave.

国内还有工作不能长时间离开

5，如果美国境内申请到回美证下来时间太久就只能考虑在中国等了，在国内等的这一两年期间我b签证是不是就作废了？

-After you file immigant application, you will not be allowed to use B-2 visa to enter US.

如果持b签证硬闯，被原机遣返的几率有多大？

-Very big and if you are denied to enter US, you might have unexpected trouble.

我父母快80了，现在每年回美国看他们两趟，如果一两年不能入境还真不放心

 

再补充一个问题，关于儿子给我申请所需要的材料

早在06年没离婚时候申请过全家绿卡，140批准后等485期间因为离婚就没再继续，所以移民局原来那个case里有家庭关系等所有文件，这次申请是否还需要重新作材料
