我是主申请人，485还在pending。但我没有使用EAD，仍然在用H1B工作。 老公是TN，还没交485。可是老公的TN工作会在12/31/2016终止，必须交485了。请教：

1。老公交了485后，就可以合法呆在境内了吧？即使在12/31/2016之后？

-Yes, and he can apply for EAD to work.

2。 可以给老公申请H4吗？

-Yes, he either files I-539 to change TN to H-4 within US now (before December 31) or just go to the US-Canada Border to get the H-4 I-94 to come back. He also does not need to change status, and just stay in US for the green card, but he had better apply for EAD to work, and apply for advance parole (AP) for possible travel outside US. Both EAD and AP application (i.e. I-765 and I-131) can be filed together with I-485. I-131/I-765 filing is free (no filing fee). 

3。 如果可以申请H4，可以在境内TN 转H4吗？还是必须出境申请？

4。因为老公12/31之前还需要用现在的TN继续现在的工作，那是不是说必须在12/31之后才能申请H4？

-He can continue to work until December 31 even if he files I-539 for H-4 because I-539 will take a few month to be approved.

5。交了485之后申请H4，会对已交的485有影响吗？

-Not at all.
