请教尊敬的8老师一个非典型H1问题。我目前的状态是EB1A cc申请pending，EAD卡使用中，去年底申请的NIW刚刚批准。我的六年H1B签证两个月前（8月份）结束，不过中间有差不多两个半月因为回国没有用完。H1B六年签证结束前我的NIW申请还不够一年，学校本来准备给我把没有用完的两个多月recapture，但是因为当时校内审核耽误了错过了deadline，最后只好用了EAD。我的问题是我目前的NIW批准能不能让学校帮我refile H1B的两个月然后申请延3年H1。学校答应给refile H1，但是他们没有办过这样的案例，所以也拿不准。请8老师帮我看看可行性。万分感谢????

-Yes, you can extend your H-1 by capturing the 2-month time and using the approved I-140, but you need to go to China to get the H-1 visa to come back after the H-1 extension is approved (which will have no I-94 you do not have a non-immigrant status at present).  If you get the H-1 approval wihtout I-94, you had better not leave US to ge tthe H-1 visa unless your EB-1A I-485 is denied. Because you don't have H-1 status currently and if you leave US, your pending I-485 may be affected. You had better just use EAD to work. If your I-485 is denied, then you can go to China to get the H-1 visa to come back to work.
