我老婆以旅遊簽證來美，現在簽證快到期了。我是綠卡，為她申請I-130且獲批準。她的I-485排期還有一個月就要排到。她可不可以现在申请B-2延期，在等待B-2延期批准的时候，假如I-485排期到了，她能提出I-485申请而不被认为是非法逾期居留吗？

-She may file your I-485 while the I-539 is pending, but USCIS will adjudicate the I-539 first. If they approve the I-539 B-2 extension application, then there is no problem. If they deny it, she will continue to be in a period of authorized stay (i.e., not accruing unlawful presence) due to your timely-filed I-485, but she will not be eligible for adjustment of status because she will not be in any valid non-immigrant status (i.e. her I-485 probably will be denied if her I-539 is denied first). If that happens, she likely will have to complete the immigrant visa process abroad at the U.S. Consulate in Guangzhou, China. Otherwise, you need to become a US citizen for her to file I-485.
