8老师您好，我2014年8月底得到EB1A批准，当时因为J1有二年服务期没完成，所以没有立即递交485.同年10月我回中国工作以满足二年J1回国服务要求，现在二年快结束了，准备十月份回美国递交485。我有一小孩（95年12月出生），今年12月份就21岁了，想帮他一起递交485,但我的律师说，因为我们没有seek to acquire permanent residence within one year of EB1A approval date(i.e. On or before 2015/8),孩子因此不受CSPA保护，
-Obviously the lawyer misunderstood CSPA. Based on CSPA, the child has to file I-485 or DS 260 within one year from the date when the PD is current if he uses CSPA benefits, but it only means the child's actual age is more than 21, but his/her CSPA age is less than 21 when the PD is current. In this case, the child has to file I-485 or DS 260 within one year even if his/her CSPA age is >21. If the child's actual age is <<21, the child does not need CSPA benefits at all!
Because your child actual age is less than 21, of course your child does not need CSPA benefits yet by this time. So, how can the lawyer say your child is not pretected by CSPA?
如果今年10月份递485的话，不太可能在他年底21岁生日前得到批准，会被age out。
-It is not true. I don't agree with the lawyer at all! Because the EB1-A PD is not current, your child CSPA age can only be calculated when the PD is current again (not caculated from the date your I-140 was approved). However, because your child is still less than 21, this is not a problem as long as the EB-1 PD is current again before his 21th birhtdate. So, your child of course can file I-485 together with you before he turns 21 if the PD is current. The CSPA age will be frozen after he files I-485, so his I-485 approval will not be affected even if the I-485 is still pending after he turns 21.
Based on CSPA, the child is always protected by CSPA no matter when you file I-485, but the CSPA age is only calculated when the PD is current. If the child does not file I-485 when the PD is current, then the CSPA age will not be frozen, and thus if the cutoff date is retrogressed (排期倒退)， then the CSPA age has to be calculated again until the PD is current again. Thus, the child may be age-out.
请问8老师律师说的都对吗？-No. What the lawyer said is ridiculous.
1）如果在孩子满21岁前递出I-485,没有CSPA保护,年龄真的不会被freeze 吗？-It will be frozen (see above). Your child is fine.
2）现在想再重新申请EB1A I-140（孩子21岁前）这样孩子就可以重新得到CSPA 保护， 但律师说移民局会confused(因为之前已经有个approved的EB1A),可能会导致deny新的EB1A.请问8老师，这个可能吗？
-Not need to file another I-140 because your approved EB-1A I-140 is still valid (the validity of approved I-140 has no expiration date).
3）另外8月份EB1A排期倒退，有没有可能我们孩子的CSPA从10月份重新current再算，而不是之前的2014年8月份？
-Correct. See my above explanation. But your child does not need CSPA protection until he turns 21.
