老师好.

我父亲2013年还是绿卡身份的时候给我申请了I-130,于是我的排期自然就是F2B的排期.父亲去年成为公民,我的排期理论上也应该从F2B改成F1了.原本应该是好事,可是过去几年F2B的排期一直比F1要快一年左右,目前看来似乎未来也不会有改变.

之前在世界日本的移民专栏看到一位律师说如果是这种情况,可以按照F2B的排期来递485,跟移民局要求说使用比较快的F2B排期.可是我觉得这种说法不合逻辑,如果F1比F2B慢的时候F1可以要求使用F2B的排期,那F1自己的排期意义何在?请问我这种理解对吗?

-After your father became the US citizen, the F2B case was automatically upgraded to F1 category, but based on CSPA,  you can request the U.S. Citizenship and Immigration Services (USCIS) to reclassify you back to the F2B category.  You may inform USCIS that you wish to “opt out” of the automatic conversion to F1 and remain in the F2B category.  Please note that , the application of this opt-out provision is not automatic, so you need to request USCIS to do it for you in writing.

Consult an immigrant lawyer, if necessary.

因为两个排期目前相差一年左右,一年时间还是能影响到很多步骤和计划的.希望从老师这里得到准确的回答.谢谢!
