-Up to you. The law only reequires the employer to file regular H-1 petition fee and lawyer fee, but does not require the employer to pay the premium processing fee.
如果H1B transfer批了，公司裁人，找不到新工作，不是也得马上处境吗？
-That is much different. If your H-1 I-94 does not expire and you are laid off, then you are out of status, but your stay in US does not count as unlawful presence. Thus, you will not be subjected to 3- or 10-year bar if you leave US. So, if you can find a job in a few months, you still can ask the employer to file H-1B and then, you can go to China to get the H-1 visa to come back. So, I personally call this kind of situation as "身分半黑".
