先生3月16号被layoff，已在layoff之前提交了F1的申请并在3月2号收到receive number。我自己也单独申请了F1。两个F1申请现在都还没收到结果，按移民局的官方说法一般F1申请受理周期为2个月半月，预计五月中旬会有F1申请的结果。
问题1：今天（4月25日）刚得到新的工作offer，是否需要等F1结果出来了再提交新的H1B申请？
-No, he may ask the employer to file the H-1 petition now and use the premium processing to get the results in 15 days. Your children and you may just also file H-4 application toegther with your spouse H-1 application. If the H-1 aprpoval has I-94, then he does not need to go to China to apply for the H-1 visa. But there is a potential problem is that if your F-1 is approved later, then his H-1 status will be over-ridden by the F-1, thus he has to go to China to get the H-1 visa to come back. So, he may just request USCIS to withdrawn your F-1 application in this case if the H-1 approval has I-94.
问题2：如不需要，是否只要在收到F1结果之前提交新的H1B申请，然后就在美国境内等待结果，假如收到H-1B Approve Letter上面没有新的I-94时，再安排出境激活新的H1B身份?

先生如需出境激活身份时，孩子是否需要和他一起出境（两个孩子之前是跟着先生的F1申请F2）？

问题3：提交新的H1B签证时，是否一定要和经办律师说清楚正在办理F1的情况？（如果可以的话，已提交F1签证申请的事情不想让新公司知道）
问题4：是否需要和新H1B经办律师律师说明上一个工作已于3月结束？
-Yes and also telll him/her your spouse F-1, your F-1, and your child F-2 are all pending.
最后一张payroll上写着cover的时间是03/01/2016-03/31/2016，给律师三月份的工资单时，是否需要和他说明雇佣合同结束的精确日期？
问题5：假如先生的F1签证被拒的通知出乎意外提前到来，比如五月初，H1B材料已提交但尚未收到receive number，这时先生需要离境吗（会不会因为F1被拒之日和新H1B receipt notice之间属于非法停留日而导致新的H1B被拒）？
-No. Just wait for the H-1 petiton results (use premium processing if necessary).
孩子是否需要和他一起同时离境？
-Yes.
或是可以留在美国境内等待先生H1B申请获批了，我再带孩子出境激活新的H4？
-No because your children F-2 are based on your spouse.
问题6：四月只剩下四个工作日，如不能在四月份提交H1B申请资料，也拿不出cover四月份的新工资单，就大概率需要出境激活新的H1B了？
