我目前只能申请I-130，因为还在等J-1豁免，估计还有好几个月。我的OPT将于明年1月过期，目前没有H-1签证的工作。这种情况还能用H-1返美吗？

-No. You may not need to file I-130. Then, you can file I-485 and I-130 concurrently after you get J-1 waiver. Thus, you might travel using F-1 or B-2 visa. But you had better not travel before you file I-485 and I-131 to get advance parole.

还是就先不出美国了？

如果我用B-1签证，签证官会不会拒签？因为我已经在美结婚？
