我的H-1B 延期刚刚递上去（I-94在16年1月到期），现在有急事要回国两周，就打算用EAD/AP combo card回来。
结果问了HR，他们说我最好办加急，拿到approval再回国签证回来。 如果在等延期中出境再用AP回来，即使回来时延期还没被批，last action rule允许我从AP转回H-1B， USCIS也有可能最后给一个H-1B approval notice但是没有I-94， 我还得出境签证激活。
我听说如果status有gap会这样，可我肯定是在I-94到期之前回来啊， 延期也在到期之前递上去了，也会这样吗？还是HR在吓唬我？
-I am not sure whether your pending H-1 extension will have a problem if you use AP to re-enter US. If your H-1 approval has no I-94, then you can use EAD to work, and you can go to China to get the H-1 visa to activate the H-1 status any time.
Of course, I am sure that it will be OK if you use H- visa to enter US during the H-1 extension pending.
我有EAD，所以可以继续工作，但还是希望在等绿卡期间保持H-1B。
