我儿子的TD 只有两天有效期了！因为我的TN 只有两天了， 虽然政府记录的I-94 有效期比2天长， 但TN 失效（TN 被H1取代）， TD 就自动失效。

我们的理解：不能再美国非法居留， 两天之内没法办成H4了， 最好的可能是：只能是在TD 到期前把TD 转H4 的文件寄出， 是吗？

-USCIS has to receive the I-539 change of status application before the TD I-94 expires.

另外， 还有没有可能， 我们9月30日专门出境， 10月1日从墨西哥入境， 我带着H1，边境会不会给我儿子H4?

-It should have no problem if you have received your H-1 approval notice..

或者还有没有其他更好的办法把TD 转成H4, TD 转H4必须雇主办吗？

-No. Irrelevant to the employer.

 

还是我们自己也可以填表办？

-Yes, file I-539. But if your H-1 has be effective, then your child TD is void even if his I-94 does not expire yet. So, the best choice is that you and he go to the border to get the H-4 status for him.
