8老师我又来请教问题了，急死了。公司经济状况不好，快要倒闭了，可是老板一直拖欠我们工资，8月份就没有发工资，就在说等客户pay 钱发工资一直等到现在还没有。我想问
1。这种情况我是不是已经out of status了？我们一直在工作着的， H1他也没有取消。
2。我现在想下周回去签证换身份，老公是H1我想换h4，我最后的一个paycheck 是7月30号，如果老板一直不发工资，赖账的话我这样回去签证是不是会过不了呢，vo认为我已经在美国out of status了？
3。DS160有一个选项是Have you ever been unlawfully present, overstayed the amount of time granted by an immigration official or otherwise violated the terms of a U.S. visa? 我应该填yes吗，如果yes是不是就肯定签不过了？
