8老师，我现在是F-1，OPT将于2016年1月中过期，过期后，现单位将不会替我办J-1或者H-1。我多年前用J-1签证1.5年，现在还没有办豁免， 也没有回国呆够2年。我和男友（公民）计划近期结婚。我想知道：

1，我结婚后，如果没有工作，opt过期，没有J-1豁免，我还能呆在美国吗？

-You will be unlawfully present (i.e. illegal stay) after the OPT grace period ends (60 days after OPT ends). However, your unlawful presence will not affect your green card application because your spouse is a US citizen.

如果可以，需要申请什么文件？

2，如果我现在申请J-1豁免，opt过期后还没有收到豁免 （可能还差2月），我能申请1-130， 或者EAD吗？

-Your spouse can file I-130 for you after you get married, but you can not file I-485 and of course, can not apply for EAD either until you get the J-1 waiver approval.

3，我的j-1visa上写的是：2 years rule does not apply. 这种情况我还要申请豁免吗?

-That may not mean anything. As far as I know, nearly all of the Chinese J-1 scholars have two-year home residency requirement. I don't know what kind of J-1 you had before, and you may check the Form DS 2019 to see whether there is the requirement there.
