Dear Master 8: My parents filed 130 and 485 simultaneously in April with no approval yet. Yesterday we received the letter indicating 485 will be dealyed to approximately 6 months and potential interview waiver
-Can we file form 131 AP for my parents to leave US with both 130 and 485 pending?
-Yes. If it is urgent for them to leave, they may go to the local USCIS Office to apply for the emergency AP. But they can not miss the fingerprinting and interview (if any).
or do we have to wait until approval of 130?
-Not necessary.
-What approval form shall we expect before leaving US?
-File I-131 application for advance parole. They need to get the advance parole (which has their picture) before leaving.
-How long can they stay in China before returning to US?
-AP is valid for one year, and as long as they come back before AP expires, it will be fine.
