请问八老师

 

我的PERM和I140已经批准。

但是USCIS的prevailing wage比我现在的工资高很多(wage1)。公司很难加到USCIS要求的工资。

于是公司的律师就找了一个有资质咨询公司做了一个我的职位的工资调查。调查回来的结果比我现在的工资只多几千(wage2)。公司同意加这几千给我。

律师的计划是用咨询公司的调查结果，重新申请一个PERM和I140. 这样加完工资后，就没有问题了。但是这样等于全部推倒重来。
-Don't think DOL will accept the wage your employer/lawyer themselves got as the prevail wage for PERM.

 

我想知道有没有可能保留已经批准的PERM和I140。现在用咨询公司调查的工资wage2,来和USCIS交涉，可以将已经批准的PERM和I140改用 wage2 呢？
-Because the PERM position is the one after you get the green card, your current salary does not matter to your approved PERM/I-140. So, you may not need to do anything to mess it up. If your employer file a new PERM and I-140 for the same position as the one for your approved I-140, your employer may need to withdraw the approved I-140 and that probably make you to take more time to get the green card. 

If your employer can not pay you the prevail salary after you get the green card, you may just find a new job and move on after you get the green card.

如果想要用wage2，是否一定要重新申请PERM和I140呢？有什么办法不用全部重来吗？
