8老师您好，我的情况是这样的：我曾经有一个EB2 Perm的140批了，之后换了工作。去年的时候自己又File了NIW的140，在这个申请里面要求retain我的旧的priority date。现在我的旧的priority date已经current了，但是NIW的140还没有动静，我想问：

1. 我现在能file 485吗？
-Yes. Provide the copies of the old I-140 approval notice and the receipt of your NIW I-140 and justify in the cover letter that you are qualified to recapture the I-140 priority date of the old I-140 for your NIW I-140 based on the  priority date portability rule:  8 CFR 204.5(e).
 

2. 如果能，我file的话，会有什么负面影响吗（除了140一旦被拒，白付了485的申请费）？
-No.

3. 如果能，应该怎么让officer知道我的140 retain了就的priority date，这个PD已经current，所以我可以file485？
