I have a similar situation in question3 途径一:

your child may renew his/her B-2 status again and again. how easily can the child's B-2 status be renewed and how many times can the child's B-2 status be renewed? is there any limted time?

我的情况是这样的：我已绿卡（EB2, NIW）；爱人和小孩在国内。我和爱人结婚是在我获得绿卡之前，而小孩出生于我获得绿卡之后。

 

时间先后顺序：结婚-我绿卡-小孩出生。

 

 

 

想请教的问题：

 

1. 小孩出生日期在我获得绿卡之后，所以小孩不能办理 follow-to-join 获得绿卡? 对吗？

2.小孩能否办理B2签证每年来美探亲？

-Yes.

 

新的签证政策B2探亲签证10年有效，所以理论或实际上小孩可以10年内多次往返美国？

-Yes, but your child may renew his/her B-2 status again and again until your I-130 priority date (PD) is current to file I-485 due to his/her age is too young.

 

 

3. 小孩办理绿卡的可能途径。

 

途径一：申请B2入境，然后境内提交I-130表。不知道小孩是否能在境内合法地等待绿卡申请的处理，不受原来 B-2 停留期的限制？

-Need to renew B-2 status (see above answer). 

 

 

途径二：提交I-130表，小孩在广州获得移民签证来美（F2A类别）。请问前后大概需要多长时间？

-This is another choice. Your child can go back to China to get the immigration visa when the I-130 PD is current. His/her illegal stay in US (if any) will not affect his/her immigration visa application in China because his/her age is less than 18 years.

 

步骤复杂吗？

-No.

 

能否自己DIY,还是必须请律师办理？

-Up to you.
