我的PERM去年11月13号submitted.
我的H1B(六年）今年9月31号到期，这六年中有35天回国。PERM 还没批下来， H1B extension 本应今年9月底submit.
今天HR过来传公司律师的话，H1B extension 只能在PERM submission date一周年后才能 submit,
我从明天开始不能到公司上班（其实从这月5号开始，就是非法工作）。
我的问题是：H1B extension 只能在PERM submission date一周年后才能 submit吗？
-Your problem is that the PERM filing was too late. The PERM had to be filed at least at the end of the 5th years of your 6-year H-1 (at least one year before your 6-year H-1 ends), thus you can use this PERM to file the H-1 extension beyond the 6-year H-1 limit.
有啥办法？
-Because your 6-year H-1 has run out, you can not do anything now, and have to leave US for one year and then,, you can be qualified for the H-1 again. You should have come here to ask us to help you a couple of months ago (before you H-1 ended), then I would have given you some suggestions to save your situation, but it is too late now.
