之前帖子8老师说可以上庭一试，今天我的律师说只要WOM就行，不需要我上庭，我想再跟您确认一下，

另外有什么重点需要跟律师提点。因为如果不上庭，什么机会能跟法官申请自愿离境和3years bar的豁免？
-Unless the immigration judge put you in removal proceedings (deportation), you don't need to do anything to the judge and just stay in US until your spouse get the US citizenship to sponsor your green card if your lawsuit does not work.
