8 老师， 还是有个问题。 如果我到了新公司， 新公司帮我转了H1-B 所以我还是以H1-B的身份在工作， 也没有再办理PERM。

 

1. 那么这样我就没有用EADcard， 所以EADcard还是在作为backup. 如果我突然被layoff， 我就可以用EADcard维持我的合法居留身份。 对吗？
-You don't need EAD to stay in US. As long as your I-485 is pending, you can stay in US legally.

 

2. 新公司可以不断帮我延期H1-B 直到我的485 approved了， 是吗？
-Yes as long as the old employer does not withdraw the I-140. If is withdrawn, you need to use EAD to work.

--- let's say my old employer withdraw the I140. so even if I get the new job more than 180 days after I filed 485, will I still have to use EAD to work?

3. 我现在的485 是以EB3 140 filed。 如果说我已经转到新公司上班一段时间，根据下个月的EB2排期， 我的排期当前了， 但是如算EB3, 还不是当前。 那我的485能被批吗？（　我在以前的公司，　EB2 和 EB3 的140 都被批准了。）
