8老师,不知您是否记得前几天我请教过您一个H1B extension以往时间计算的问题
具体内容我列在下面。
今天我在皮老师博客上读到这样一段话

"还有一个日期,可以称之为 Validity Dates. 这个日期在 USCIS 的文件上不是这样表述的,通常在 Approval Notice 的 Notice Type 下显示为 "Valid from 10/01/2007 to 09/30/2010". 它表明的是你的新身份开始的日期,但在那之前,你的身份还是老的类别,不变。在填 Current USCIS Status 时,这一细微之处颇为重要。
当然,身份延期不在上列,转为 F-1/2 也不在上列。"
这个意思是不是说H1到F1 adjust status 这段时间不算H1的时间呢
因为这段时间有8个月之久,对我延期非常重要

8老师,关于第二个问题,我想您可能有一个误解
Jan 9, 2012 是第二个H1B approval notice 上的start date
Jan 14, 2012 是我actual pay check上的start date,也就是实际的start date
我想请教这5天 (14-9),是否应该算在H1的 spent的时间里
另外关于那7个月的H1B时间,我想跟您再确认一下,因为关系重大
就是
2011.4月底我的第一份工作已经结束
2011.4月底我已经开始上学,file I539 change of status, 2011.5.3 receipt notice
2011.12.1 approval notice of change of status from H1 to F1 starting date 2011.12.1
也就是说着7个月我没有工作,但是change of status 仍然用着H1的时间?
那我就没法claim 7 months extension in my H1B renewal?
这7个月有没有一个change of status这样的grey period status,这个是非H1及F1么?

最近在搞H1B extension,有个H1B remaining days的问题求教您
我的情况是
第一段工作
H1B 10/2009 to 4/2011
四月底第一个工作结束,在4/29 submit change of status from H1 to F1, 移民局 receive notice 5/3/2011
2011.12.1 移民局approved H1 to F1 change of status, valid from 12.1.2011
第二段工作
Approval Jan. 9, 2012 to Nov 2014
我实际开始工作 是 Jan 14, 2012
期间回国一个月零一天
我求教的问题是
1) 2011年5月到11.30这段时间change of status, 算不算H1时间。因为我4月底工作已经结束了
而且我4.29号就开始上课了
-Because your F-1 was pending, the H-1 clock was still running until your F-1 was approved. So, this period of time was still counted as your H-1 even if you stopped working.
2) Jan 9, 2012 approval date 到 Jan 14, 2012 actual start date这5天算不算H1的时间
-No. The H-1 clock stopped when the F-1 was approved even if you started study a few days later.
3)回国1个月零一天应该不算H1时间吧。
-Correct.
不过I94只能证明回美国时间,怎么证明我的离开美国的时间呢?
-The stamps on your passport when you entered and left China, and the stamp you reentered US can be used as the evidence of your stay in China.
