PD排期将近Nov。 1st.  EB3.两年半前回中国分公司, 属于中国分公司录用，回来前I-140 已批准，前两天刚跟美国公司的in house legal 通话，了解到为了将绿卡进行下去，必须要转成美国总公司雇员，身处异地可以选择consular processing ....但有些问题她也不能回答，帮我约了outside counsel to further consult on Tuesday. I would like to be fully prepared for my case prior to the call.

 

现有问题如下：（有点多，但实在是菜鸟一个，请多多指教，万分感谢）

1.有无可能先递交I-485申请，然后再找到美国总公司的职位？-You have to come back to US to file I-485.

 

 

 2．最晚什么时候我需要被美国总公司rehire, 否则会错过排期？-Your company need to give you a letter verifying that the position for the PERM I-140 is still available  to you in US before you file I-485 within US or apply for the immigration visa in China. I don't think it is a problem because the company has filed the PERM/I-140 for you and continue to hire you. You can come back to US to work after you get the green card.

3. 如果排期错过，多长时间后会再排上？还是申请作废，重新来过？-No. The I-140 is always valid unless your employer withdraw it.

 

 

 4. 如果用Consular Processing, 人在中国还需要持有non-immigrant visa 吗？
-When you are in China, you do not need any US visa/status because you are a Chinese who is in his home country.

5. 从consular processing 到green card approved, 如因公需要进出美国需何种签证？
-B1 visa.

6。consular processing 劣势是什么（比如：比AOS时间长吗？
-Yes.

或者对最终拿到绿卡有风险吗?-Not different from filing I-485）在曾经律师给的资料中读到“Consular process is not eligible for appeal" 是什么意思？-That means if you fails in the visa application, you have to apply for it again, can not appeal (useless to complain).

7。如果选AOS，回美国工作需何种签证？-H-1 or apply for EAD.

需要花多少钱办下来？

8。Consular Processing vs。AOS 各花多少时间？-Case by case and also depends on whether the PD continue s to be current. I think your employer/lawyer may not indicate that you will use the consular processing to apply for the immigration visa in China. If so, your employer needs to file I-824 to request the consular processing, which will take extra time for you to get the visa. So, ask your lawyer about this issue.
