 请问8老师，皮老师和经验人士：加拿大公民在美国递交h1b 申请以后，能否离境返加拿大探亲？然后等h1b 批下以后再持h1b入境美国？我小孩现持F1-OPT, 6 月底到期。6月初想回家探亲2周后返美结束现单位的工作。7月1日去新的单位工作。但6月初h1b 可能还没批下。请问

 

 

1：假如h1b还没有批准前返美，可否再以F1-OPT 入境？

-Yes, but the H-1 approval will have no I-94. Thus, your child need to get the H-1 I-94 at the US-Canada border using the H-1 approval notice.

 

 

2：假如h1b批准后返美， 可否直接以h1b 入境？

-Yes. Your child can enter US using the H-1 approval notice in advance up to 10 days before the H-1 is effective, or after the H-1 is effective.
