我是加拿大护照，老公的H1b刚刚拿到批复I797延期3年附有新的I94.但是我的H4办理I539的时候已经过期一周了。律师没有和老公的一起申请。他说加拿大护照是不需要的。

现在看到网上办理时间需要5个月，现在非常担心。我是否属于非法滞留？不过很幸运我换了新的驾照（有效期1年）。现在需要出境吗？还是死等？谢谢！
-I suggest you to bring your spouse H1 approval notice and his recent 3 month paycheck stubs and your passport to the US-Canada border to get the H4 I-94 because your "H4办理I539的时候已经过期一周了". Also bring your I-539 filing receipt with you though it is useless, just in case.
其实当初我的I94上的日期是错的，它应该和老公的I797上的日期一致，对吗？

但是却少了半个多月。我们也是最近才发现的。我和儿子一起入境，都是H4,可儿子的是9月30日，我的居然是9月12日。真是莫名其妙？！
