请问8老师、皮老师: H1b 批准但需要回国签证

昨天h1b批下来了，但没有I-94.　公司律师说要全家一起回去中国签证，理由是签证官会说"Where is you wife?" Since she is out of status, we need her to come back before we can approve visa. 我希望我自己先回去，万一拒签的话，我妻子也可以在这里处理一些房子等事务．律师的说法对不对呢？

还有律师说ds-160 "Did you ever out of status in US" 我要回答yes, 因为我的h1b有8个月＋4个月的waiting approve gap了．这个说法对不对？谢谢！

还有H1b的终止日期给延长了8个月，不知为什么．
