863211 or Pijiang please: Status change question

My current job is supposed to end by the end of February.  I just got a new job offer and the attorney will contact me soon to work on H1b transfer. Before I got the new job, I also prepared to change my status to F1 and paid 200 dollars online for Sevis fee. I haven't mailed the I-539 yet. 

So what do I need to do now?  If my h1b transfer doesn't happen before the end of February, do i still need to file for i-539? 

If I don't file for I-539, can I get the 200 dollars sevis fee back?
