请问各位老师,我们的排期是09年1月6日,主申请人是我老婆,生物领域的niw,现在的情况是,lp的老板马上没有funding了,已经告诉lp只能工作到2012年2月9日,然后,允许lp从2月份到5月份休3个月的personal leave来保持h1b。正好我找到了另外一个城市的工作,现在我是opt,现在lp想赶紧和我一起过去在那边找工作。
现在的情况是,估计下个月我们的排期就到了,应该可以在2月1日递交我们的485申请,
第一,如果可以递交的话,请问,我们这种情况还可以递交么?
-Yes, but the problem is that if USCIS send your wife's RFE for her employment status and she has no job, ehr I-485 probabaly will be denied.
因为我lp的雇佣终止在2012年的5月份(从2月10日开始休personal leave)。
第二,我们这种情况是不是应该等到我lp找到新工作办好新的h1b再递交申请呢?
-I think so. She can file her I-485 anytime as long as her find a job in the same/similar area.
第三,是否我们也可以马上在2月1日递交485申请,等待ap和ead,这样我lp就可以不再依赖h1b了,可以从从容容的找工作了呢?
-My suggestion is that she had better not file I-485 at this point and look for a job at least until May 2012. Also, as long as her I-94 is valid, she still can stay in US legally without a status for < 180 days without affecting the I-485 filing. So, she may not need to file I-485 before May 2012 unless she find a job before that date.
但是这样的话,是否要出示雇佣证明?
-Must need 雇佣证明 for NIW I-485 filing even if she wants to file I-485 now.
如果到时候没有找到新的工作,是否会有极大的风险呢,多谢各位老师了
