So, you mean i have to get I-94 card from my lawyer, otherwise i can't go to China without it, right?
-The lawyer/employer is suposed to give the lower part of the I-197A with the I-94 part to you (you ahve the right to have that). So, as them as soon as possible.

If my employer receive I-797B which has no I-94, then i have to go outside US to get the H1 visa to activate my h1 status.You mean I have to US Embassy in China to get a new H1 visa.

I could not smooth come back USA only with AP.Sounds so complicated! I am wondering if i should go to China this time? (big headache)
-You do not have any problem to come bac using AP. The problem is that if your H1 petition was approved without I-94 (I-797B), you were not H1 status ye until you get the H1 visa to activate it and you can not wor under H1 if you do not activate your H1 unless you use EAD.

But I am sure your employer should have received I-797A, otherwise they should have inform you to stop working. So, just contact your lawyer/employer (HR) to get the I-94.
