-Your LD is not qualified to 保留旧PD from the old employer because the I-140 has not been approved yet before leaving the old employer.

在新H1失效前,只要新雇主递出PERM申请就可以吗? 还是需要递出140, 或140批准?
-Only one way that your LD can extend his H1 beyond the 6-year duration:
The new employer has to file the PERM and get it approved, and then file the I-140 within 60 days to your LD's H1 expiration (i.e. between Jun. and August) and use premium processing to get I-140 approved. After that, your LD can be qualified for extending the H1 for another 3-year duration.

But the problem is it takes about one year to get the PERM approved in these days. So, it is very risk for your LD to change the employer now.

My suggestion is: your LD had better continue to work with the old employer and get the H1 extention beyond the 6th year (had better get i-140 approved). Then, he/she can consider changing the job.
