Called USCIS regarding laid off after I485 pending and unemploy

H1b, filed I130 (married w/ a citizen), I485, I765, and I131 on Feb. 21, 08. Company will be closed on April. I was worried about my legal status. The lady at USCIS customer service confirmed to me that since I filed I485 when I had H1-b and I have I485 receipt, I will have legal status and do not need to leave US. I also asked if Unemployment Benefit is consider Public Welfare, she said no. Unemployment Benefit is insurance that employee and employer paid in case a worker lose their job. If I get UB, it will not affect green card.

I checked EDD website, and find out that if I have EAD card (which I am waiting), then I am eligible. The reason is that to be eligible to get UB, I have to demonstrate that I am able to immediately available to work and accept a job. I don't think that apply to someone who will not have working status until I get my EAD... haha.
