you definitely can use AP to come back. but, you got to know the risk. some people say that your immigration status would not be changed if you use AP. some people say your status would be changed to parolee. actually, there is no clear definition on this matter. consider the worst case, if your 140 got denied, then you have to leave US. do you want to take the risk? you might need to consult an experienced lawyer.
