Unlawful Presence:
THIS PROVISION IS VERY IMPORTANT!
Beginning April 1, 1997, any foreign national who is “unlawfully present” in the U.S. for
more than 180 days but less than 1 year and who leaves and then seeks re-admission
to the U.S., is inadmissible for 3 years. If a foreign national is “unlawfully present” in the
U.S. for more than 1 year, the foreign national is inadmissible to re-enter the U.S. for a
period of 10 years. Waivers may be sought in certain cases. Talk to an advisor if you
have questions about unlawful presence.
