You are almost right. Yes I got my OPT last July. My OPT was invalid not because I registered again in the Fall of 2003 but because I didn't graduate in time as my OPT application stated. Actually, I could graduate in the summer of 2003 and get H1-b. but DSO told me that I lost the benefit of F-1 student due to not graduate in time. I had to go back for a visa if I graduate at that time.I just didn't want to take risk to get back for visa.
Now, I find reinstatement is big burden for me. During the reinstatement, I have to pay own tuition and can not get my RA paid from school. Reinstatement usually takes 2-3 months. After 911, it takes forever.
Since my OPT was inactivated in the SEVIS system and OPT student has to report to SEVIS system. I can not work after graduation.
DSO told me I could re-enter with a new visa if my reinstatement is denied. If USCIS deny my case, they will state a departure date on my I-94. My illegal status will begin after the departure date on I-94.
Is this contradictory to the 180-day's regulation?
