我跟公司律师沟通后,公司律师仍然坚称不能保证没有I-94 gap,但提出file H1B amendment的替代方案。
那就是以work location变动为由,用一个新的公司地址和我家庭地址(WFH)作为新的work location。(我们公司的building很多,有多个street地址,距离都在方圆5 miles以内。我家离公司也是20个mile以内)提交H1B amendment of work location change。实际上这种距离都是within the same metropolitan statistical area (MSA),压根没必要提amendment,也不知道会不会被拒。当然USCIS应该压根不会查距离。
律师说amendment里可以注明start date为6/2/2023(我儿子护照过期时间),然后USCIS会按此start date给新的三年,6/2/2023 - 6/1/2026,跟延期等效。
听起来似乎很完美。想请8老师帮忙看看,是不是有什么risk。

So, it is fine to file the H-1 and H4 extension before June 1. Also, you and your child may tralvce to China after the H1/H4 extension is approved. Thus, when you return to US, your child will get the new I-94 for new H4 duration and the gap will be cancelled.
Of course, it is also fine to file H-1 amendment as the lawyer said.
我听说USCIS常常胡乱给3年有效期。这个amendment虽然会批三年,但会不会真正有效的只有几个月(截止至7/1/2023,我的H1B过期日)。amendment只是对当前H1B的修改而已,并不能起到延期的作用?

If you worry too much, your child may file I-539 for H4 extension from June 1 to July 1. Then, he/she can file another H-4 extension together with your H-1 extension with the effective date on July 1. Of course, this will cost you an extra H4 extension filing fee.
