网上搜了一下好像没我这样的case… 基本情况是：
485 3/21交的，现在pending (Eb1)
OPT 6/24到期，从老学校辞职。没有申请OPT延期，因为已经交485了
新学校给我申请的H1b non-cap 已批准 （H1b申请的I-129表上填了485的收据号并附上了485收据），批准件上有新的I-94。生效日期 8/15
我的问题是：6/25-8/14，我OPT结束，属于已经out of status，虽然是legal presence (60 days grace period)
我这种情况可以8/15境内自动身份转换成H1b吗？

学校律师说一般需要有 “有效的status”才能自动境内Change of Status，
-You can change your status to H-1 during the F-1 grace period (not have to have a status in your case), and that is why USCIS approved your H-1b with the I-94.
但移民局的I-797批复件上又给了新的I-94，说明应该也能境内自动转。_Correct.
是不是跟我已经交485有关呀？OPT和H1b之间有Gap还能境内自动转身份吗？-You cannot work during the F-1 grace period. If you got the cap H-1b, then you could work in the period of the OPT and H-1B gap. This is the difference between the cap H1B and non- cap H-1B.. So, you have to wait until August 15 to work.
