8 老师，我律师说虽然我的i94还没过期，但因为他们一直没有回复我前面那个H1b的RFE，我的case一直是pending, 而我就是一直在Pending 状态下工作了好几个月。 所以他说有可能新的h1b会没有i94, 那我就得再出境。 是这样吗？
-I don't agree with your lawyer. You are still under H-1B status to work because your old H-1 status does not expire yet (not work during the H-1B extension pending).  So, the H-1B extension petition withdrawal does not affect your anything (it is equal to that your employer has never filed that extension petition). Thus, your employer can file a new H-1B extension petition now before your current (old) H-1 status expires and it will be approved with I-94.

一般情况像我这样在Pending状况工作了几个月，移民局会怎么处理，是给个新的i94还是不给？ -You will get the new I-94. Ask the employer to use premium processing if you worry too much.
