if my 6th year H1B expires on Dec 8, 2015
from June 1 to Aug 1, 2015, I come back to China for visit.
When i go back to US on Aug 2, 2015, I can file a 7th year H1B extension based on 365 days of pending PERM
I choose not to recapture the days on my 7th year extension, then I will get an extension to Dec 7, 2016.
if my first PERM get denied after the 7th year extension get approved using premium processing in Sep 2015,
I then decide to file my 2nd PERM.
On Dec 6, 2016, can i recapture the three months from June 1 to Aug 1, 2015 while I was not in the US and extend
my H1B for another year after 365 days of pending PERM, so I can get a 15 months of extension in my 8th year H1B?
-You can recapture the time you spent in China when you file H-1 extension beyond the 6-year limit. For example, you spend two months in China, then you can extend your H-1 for one year plus two months (total 14 months) using the PERM from the date your 6-year H-1 expires.
Another question is that can I recapture the days in the 7th year extension of my H1B if there are two months in my
7th year that I am not in the U.S.?
