Due to family emergy, we have to go back to China soon. Currently, our H1B will expire within 30 days, and extension has been filed one month ago. Both h1B and AP are pending. We have canada passport.

So, do we have any risks coming back to US?

-If you leave know, you have to stay in China until your H1 extension is approved and then, ask your employer send the H1 approval notice to you to apply for the h1 visa to come back. Another choice is that you may go to the USCIS local office to apply for the empergency AP if you are really in emergency (provide the evidence of emergency and the AP receipt).
