回复：h1b和h4的先后顺序

我问律师是不是h1b在h4之前批准的话，h4之后批准的话，我是不是要离开美国激活h1的签证。律师的回答是，h1b批准之后，如果h4还没有批准，可以取消h4的申请。

我从来没有听说过还可以取消申请这回事，看到网上也没有提到这种情况。请问，律师说到正确吗？

-Yes. As long as you file the new h1 before the old H1 expires, you have no problem to cancel the H4. If you file the new H1 after the old H1 expires, you will have a status gap if you cancel the H4, but that small gap normally does not affect you anything.
