我的H1B，6年，马上就到期了。可是由于公司的原因，PERM还没有递交上去。从去年，我就一直催公司，但是公司一直拖。现在公司的说法是，只要是申请PENDING就可以续H1-B，但是我怎么记得一定要I-140PENDING才可以续H1-B呀。公司说法对吗？

如果没有办法续H1-B，有没有其他办法可以保证现在的工作呢？
-No unless you are qulified for O-1 status. You may change your status to other status such as H4, F1, etc. before your H1 reaches the 6 year limit and then, after the PERM is filed for one year, you can change the status back to H1 and extend it beyond the 6 year limit at the same time. Or After the PERM approval, and use the premium processing to get the I-140 approved, thus you can extend your h1 for another 3 years beyond the 6 year limit.
Another choice is that you may just go back to China and wait for the PERM filing for one year and come back to extend the H1 beyond the 6 year, or stay in China for one year to get another 6 year H 1period.
