非常感谢8老师！非常有帮助。孩子是我朋友的抚养权，从小和母亲生活，年幼，所以急于母子美国团聚，继续打扰请教：

1. Scenario 1: 孩子如果用澳洲护照免签入境，就不能在境内申请公民继父130担保的485 AOS了吗？
夫妻是可以的，继父子就不行了吗？
-Technically, it is also OK to file I-130 by the step father and the child to file I-485 at the same time if the child enters US using "免签入境" based on the new USCIS Memo, but had better do it about two months later and before the I-94 expires. Also be careful to answer the question asked by the CBP officer at the port of entry in case they think the child has immigration intent before entering US.


 2. Scenario 2：先带孩子来美国生活，同时申请境外的继父担保130，等收到广州领事馆通知后，再带孩子回去办体检面试签证。这种做法会不会违反什么规定而绿卡被拒？
-That will be fine.

（时间超过三个月，孩子美国的免签期限可能会逾期形成滞留）
-It does not matter (not affect anything due to the child < 18 years old)..

3. Scenario 3：直接让孩子在中国拿到绿卡再来，时间太长了，听说要一年到一年半，这种情况下办继父130或者随同母亲的824，一般那个时间更短？
-Had to file I-130, not be qualified for I-824 following to join.
