最近被移民的事情搞得很困惑，想请教下各位老师。

背景：

本人大姨是美国公民，2002年为母亲、父亲和我申请了F4亲属移民（一起申请，母亲作为主申人）。2010年排期到了，但是因为母亲身体不好，就没有继续申请下一步的面签等等，一家人都以为这个移民申请作废了。2015年7月我申请F1学生签证来美国读硕士。2016年2月突然收到NVC的邮件，表示这是最后提醒，一年内再不申请移民则排期作废。于是全家人再次开始准备移民。

问题：

1. 我的生日是1994.2.3，目前已经满21周岁（移民局登入后的页面上依然还有我的名字，底下括号child）。2010年排期到的时候我还没有满21岁，但是过了六年才开始继续申请移民，请问这样还能收到儿童保护法案的保护吗？

-Probably you are still not age-out yet. You can calaulate your CSPA age:

your CSPA age = your current actual age (i.e. 22 plus 50 days) - I-130 pending dates

Note: I-130 pending dates = I-130 approval date - I-130 receipt date

You can fine the I-130 approval date and rceipt date on the I-130 approval notice.

If your CSPA age is < 21, then you are not age-out and you can either file I-485 within US after your mother enters US using the immigrant visa, or you can go to China to apply for the immigrant visa together with your mother.

2. 目前大姨刚刚交完agent的费用，一家人正在准备填写DS-260，请问我也需要填写DS-260然后回广州一家人一起面签吗？可以不填DS-260然后直接填写I-485在美国转身份吗？

3. 如果必须回广州面签，会对F1签证造成什么影响？面签完还可以以F1身份回美国吗？

-If you go to China to apply for the immigtrant visa, you have to use the immigrant visa to reenter US, not F-1 visa anymore due to immigrant intent.

需要申请回美证（advanced parole）吗？

-You can not apply for AP unless you file I-485 within US.

4. 暑期学期准备从硕士转为博士，可能需要新的I-20，请问申请移民所表现出的移民倾向会不会影响SEVIS给我发放博士的I-20表格？

-Because the F-1 renewal/transfer does not need USCIS approval (only need the school to issue the new I_20 and put the information to SEVIS), you should be fine to change the F-1 study program.
