1) 我先生是硕士学位，而且在美工作十几年，应该算比较High Level的码工，在大公司工作，收入也不错，以前申请过EB2 I-140, 后来换了工作，现在公司按EB2申请的Perm已经批准，我们前一个EB2的Priority Date 是2014年8月，所以现在按EB3，我们可以同时File I-140和I-485，但是按EB2只能先申请I-140，不能申请I-485, 因为我孩子已经上大学，很担心如果等EB2 I-485 current，万一川普的移民计划通过，孩子因为超过18岁，就不能和我们一起File I-485了，
-Not true. Your child can file I-485 with yours before his/her CSPA age turns 21 years old (i.e. his/her actual age of 21 years plus your I-140 pending time).
所以我们想申请EB3，可是律师说不建议申请EB3，但可以，不过后果自负，想请教一下有什么后果呢？
-The lawyer may worry about your I-140 may be denied.
我是看到有些人说，Perm打广告时，要求比较高的，就要申请EB2, 所以我在想律师是不是意思申请EB3有点over qualified, 所以容易被reject？有这种case被reject吗？如果reject, 还可以重新申请EB2吗？
-Your employer may have to file another new PERM if the I-140 is denied. In my opinion, you may file EB2 I-140 and use premium processing to get it approved in 15 days, then file another EB3 I-140 (downgrade the EB2 to EB3) and I-485 together. Thus, if your EB3 I-140 and I-485 are denied then you still can file another I-485 based on EB2 I-140 later when the EB2 I-140 priority date is current.

2) 如果现在同时file I-140和I-485，因为I-485要等，所以还有必要file I-140加急吗？
3）如果现在同时file I-140和I-485，是不是就可以给我孩子申请EAD了？还是说可以同时递交，但只有等I-140被approve后，EAD才会被approve? 大概要多久呢？
4) 在递交I-485时，无论是否以后会用到，是不是还是先把AP和EAD一起申请了？-Yes, you can. EAD and AP applications are free, anyway.
5) 如果现在递交I-485, 我是H1B配偶H4签证，我已经订了4月中回国的机票，还可以回国吗？-Yes.我可以用H4签证回美国吗？-Yes.
