回复：律师FILE 140 时把 EB2 错成 EB3, 如何更改, 急!!!!!!!!!!!!

语 律师怎么能犯这种低级的错误,而且在这么关键的时刻.有两个问题,在线等,明天好跟律师谈:

The petitioner is encouraged to submit correspondence requesting the error be corrected. The adjudicator will consider the request at the time of adjudication. An amended I-140 receipt will not be issued. A new fee is not required.

 1)      这种情况,I140 会不会被直接 deny. 如果把EB3写错成EB2可能会deny. 但我的case要求的bachelor+5 year experience.

-They will approve your case as EB3.

2)      如果我的I140被批准,考虑到我的 current H1-B下周末就到期,可不可以先递交H1-B extension in premium processing.等我的H1-B extension 批下来之后,再递交I-140 amendment. 如果必须先递交I-140 amendment肯定是来不及了.

3)  有什么建议吗

-Ask your lawyer to write a letter to USCIS immedaitely now (enclose the I-140 receipt) to request USCIS to fix it (change the EB3 to EB2 and approve it as EB2). Not need the I-140 amendment, not need to pay fee.

If your case is approved as EB3, then your employer/lawyer can file I-140 amendment to request change. Or just file a new I-140 based on the approved PERM (the PERM is still OK for EB2).
