我老公申请EB2 收到移民局的RFE。我老公不太明白怎样的条件才符合这个212e：在本国或居住地居住够两年的要求。
我老公是孟加拉人，他2000年来美国的时候是J2， 我公公是J1，他作为家属随行 。然后2001年我老公去了墨西哥申请了学生签证F1，来美国读本科，暑假都有回孟加拉。2003年我老公本科毕业，然后拿resident permit去巴林工居住。（那个时候我公公在巴林工作居住，全家人都拿的是巴林的resident permit) 2005年我老公又来美国读硕士和博士，偶尔暑假回家。然后2012年拿到H1B。2014年10月，I140获批，同月提交了I485。2016年1月26日收到到RFE，要求证明符合这个212e：在本国或居住地居住两年的时间。
他在孟加拉呆的时间主要是暑假，零零碎碎加起来有一年多，在巴林呆的时间是整个的，有一年半左右，加起来超过两年。但是巴林这个一年半算不算，他一直没有办法找到答案。
-He has to stay in 孟加拉 for two years. His stay in 巴林 is not counted as the two-year home country residency. One solution is that he may apply for J-2 waiver by himself independently because he is > 21 years old. But it takes time to get the J-2 waiver, so he has to ahve a legal status (e.g. H-1B) to stay and work in US. His I-485 will be denied very soon because he can not provide what the RFE asked at this time. After he gets J-2 waiver. he can file I-485 again.
