1. 关于EAD申请: 因为我现在找工作已基本有了眉目, 迫切需要工卡能及时到手(八月底之前). 为了保险起见, 我是否需要在申请这个绿卡的EAD的同时, 也试着申请作为H4的EAD(五月底开始受理), 来个双保险? 这样的话, 想知道一下:
两个一起申请是否更加牢靠, 还是实际上没任何帮助, 还是会相互影响, 反而坏事?
-USCIS will only approve one application, and deny another if you file taw EAD applications at the same period of time. By the way, there is not fee for I-485 based EAD application, but you need to pay the I-765 filing fee for H-4 based EAD application.
2. 我太太作为H1B主申请人将不申请EAD以免节外生枝, 但她的I485批准是否会影响我的EAD批准, 也就是说, 到file I485时, 我俩的申请是不是开始完全分开对待还是我还是完全依附于她(包括EAD)直到Green Card真正拿到为止?
-Your EAD is irrelevant to her case, but her I-485 has to be approved first, then your I-485 is approved later; or both I-485s are approved at the same time.
3. I134: 我们的通道是EB2 PERM, 是否有必要填I134或I864? 我有同学跟我们情况一样, 但当年填了I134表, 但这次我左看右看I485及I134的instruction及网上的讨论, 发现I134或I864好像根本用不着填, 想向您确认一下.
-Not need any.
是不是只要employment letter就已经足够了?
-Yes.
是否还要最近三年的W2或IRS的tax transcript或最近三个月的paystubs?
-No.
4. 复印件和原件: 这事我前段时间问过您, 就是有关criminal history的文件是否要寄原件, 您的回答是复印件就行. 但我后来又仔细读了I485有关Initial Evidence: 1. Criminal history: A-D的详细解释, 发现都要求original or court-certified copy (别的文件倒的确基本是复印件就行).
-Then, you may provide the original one, and keep the photocopy of your personal record.
现在我已拿到一封从DA Office发出的官方信件详细解释我arrest后处理过程(have not been charged, and will not be charged if I complete DPP successfully), 及一些别的supporting documentation(详见我以前的帖子).
是否这封信我最好寄original, 别的supporting就用copy算了?

5. VISA number/entry/日期: 我有新旧两本护照, 新护照在我拿到后从未使用它出入美国, 没有一个图章, 而作废的老护照上有我所有出入美国的信息, 包括去两次Canada和一次Bahamas的, 都在回来时因去的是adjacent country和island都未申请入美签证直接入境.
这样的话, 我是否需要复印新旧两本护照,
--Provide the copy of your new passport (information pages only), and the copy of the visa pages and entry pages of the old passport (not need the other rest pages).
并在Nonimmigrant Visa Number&Consulate Where Visa Was Issued&Date Visa Issued处用我最后一次的在中国获得的签证信息(比去Canada&Bahamas早),

-Yes, the last entry was the one she got the I-94 at the port of entry when entering US . Do the same way for your I-485.
7. 我太太的I94 Number每次改或延签证后都发生改变, 填Part. 1: I-94 Number(还有I765 Item10)是不是以最近一个为准?
-Yes, it is the current valid I-94 (not expire yet).
8. 我现在没工作一直在家, current occupation是填unemployed, 还是填homemaker?
-Put "unemployment".
9. 女儿出生在美国, 查了她的美国护照, 只有护照号和SSN, 她是不是根本就没有A #, 这样填Part3. B.亲属时可以跳过A#?
-leave it blank or put "N/A".

10. Part 3.1. Date of Intended Departure & Excepted Length of Trip: 现无具体回国计划, 这两个空如何填最好?
-Estimate a departure date after 3 months or later and length (e.g. 6 months, etc.) there.
11. Part 4.1.b. List the countries you intend to visit: 现无具体打算, 但很可能去Canada, 是否填了国家不去也可以?
-It does not matter. You can go or not go to any country.

12. 我用过OPT一年, 拿过两个EAD, 填11. Date时填最早的还是最晚的?
-the latest one.
13. 同时递交I485 & I131 & I765时, 很多supporting document是重复的, 我是否需要递交一份就够了,
还是每个各来一份?
